Sweepstakes Description: Deal's 10K Giveaway II ("Sweepstakes") begins on March 9, 2009 at 12:00:01 a.m. Eastern Time ("ET") and ends on September 6, 2009 at 11:59:59 p.m. (ET) ("Sweepstakes Period"). The Sweepstakes consists of twenty-six (26) separate individual weekly Sweepstakes ("Weekly Sweepstakes") and one (1) overall Sweepstakes ("Overall Sweepstakes"). Each Weekly Sweepstakes begins on a Monday at 12:00:01 a.m. (ET) and ends at 11:59:59 p.m. (ET) that following Sunday ("Weekly Sweepstakes Period"). As part of the entry process, participants are asked to either call the toll free number or visit the web site (as stated below) and enter his/her entry information (as applicable) as well as choose which Game case number he/she thinks contains the $10,000 weekly prize ("Game"). Only those who choose the correct Game case number (1-5) for that particular week will be entered in that Weekly Sweepstakes. Entrants who provide the correct Game case number for any given Weekly Sweepstakes will be entered into the Overall Sweepstakes, as described below. Sponsor's computer is the official clock for purposes of Sweepstakes participation.
Eligibility: The Sweepstakes is open only to permanent legal residents who are physically located, and residing in the 50 states of the United States and D.C., and who are 18 years of age or older as of the date of his/her entry. Participants must have either a valid social security number and/or a valid U.S. personal tax identification number. Although each entrant must meet the above eligibility requirements to enter, his/her entry will not be included in a Weekly Sweepstakes drawing or the Overall Sweepstakes drawing unless he/she has chosen the correct Game case number for that particular Weekly Sweepstakes. Employees of Trilegiant Corporation ("Sponsor"), Affinion Group, Endemol, NBC Universal, Inc., Telescope Inc., Sweepstakes administrator, participating affiliates, stations airing Deal or No Deal (the "Show"), their advertising or promotion agencies, those involved in the production, development, implementation or handling of the Sweepstakes, any agents acting for, or on behalf of the above entities, their respective parent companies, officers, directors, subsidiaries, service providers, any other person or entity associated with the Sweepstakes (collectively "Sweepstakes Entities"), members of their immediate families (spouses, children, siblings, parents), and persons living in the same household as such persons, whether or not related, are ineligible to participate in the Sweepstakes.
How to Enter: To enter via the internet: Starting on March 9, 2009, visit the Sweepstakes web site at www.dealornodealclub.com ("Web Site") or visit any participating NBC affiliate stations' web site during the Sweepstakes Period; click on a Game case which will access the Sweepstakes entry page; then complete and thereafter transmit the entry form. Information required on the entry form (collectively "Entry Information") consists of entrant's choice of Game case number 1-5, first and last name, complete street address (no P.O. boxes), city, state, ZIP, daytime telephone number (including area code) where he/she can be reached on Mondays between the hours of 11:00 a.m. (PT) and 1:00 p.m. (PT), email address, date of birth, gender and acknowledgement of his/her acceptance of these Official Rules (collectively "Online Entry"). The list of NBC affiliate stations participating in the Sweepstakes is available on the Web Site during the Sweepstakes Period. To enter by telephone: Entrants must call the Sweepstakes toll free number (888) 332-5105 (which spells out 888 Deal 10k) ("Toll Free Number") by a touch-tone phone, follow the prompts to submit his/her choice of Game case number 1-5. By doing so, entrant accepts these Official Rules (collectively "Telephone Entry"). Entrant's telephone number will be automatically captured during the call and will serve as the identifier of the entrant, but calls that are restricted, blocked or made from pay phones will not be accepted. Limit either one (1) Online Entry OR one (1) Telephone Entry (collectively "Entries") per person/per day for a maximum of seven (7) Entries for each Weekly Sweepstakes (regardless of method of entry). The maximum potential number of Entries that could be included in the Overall Sweepstakes is up to one hundred eighty-two (182) per entrant (regardless of method of entry). Multiple Entries submitted by the same person in excess of the above stated limits will be disqualified. Entries must be received between Monday at 12:00:01 a.m. (ET) and 11:59:59 p.m. (ET) that following Sunday and must be contain the correct Game case number for that week in order to be eligible for that particular Weekly Sweepstakes and to be included in the Overall Sweepstakes ("Eligible Entry"). Entries for the last Weekly Sweepstakes and the Overall Sweepstakes must be received by September 6, 2009 at 11:59:59 p.m. (ET). If a participant is a resident of a jurisdiction that deems him/her to be a minor (residents of Alabama or Nebraska between 18-19 years of age or residents of Pennsylvania or Mississippi who are between 18-21 years of age), he/she must obtain parental/legal guardian consent prior to entering or submitting any personally identifiable information. Proof of delivery or receipt of an Entry will not be deemed by Sponsor as proof of Entry. Any attempted form of participation in this Sweepstakes other than as described herein is void.
Prizes/Odds of Winning: Twenty-six (26) Weekly Prizes will be awarded (one (1) Weekly Prize for each of the twenty-six (26) Weekly Sweepstakes): Each weekly prize winner will receive $10,000 awarded in the form of a check issued in his/her name ("Weekly Prize"). Approximate Retail Value ("ARV") of each Weekly Prize is ten-thousand dollars ($10,000). One (1) Overall Prize: One (1) Overall Sweepstakes prize winner will receive one (1) AutoVantage Enhanced one (1) year Membership Package consisting of: 24/7 emergency roadside assistance; maintenance discounts at more than 19,000 service centers nationwide; trip routing guides, new and used car information; car rental and hotel discounts ("Overall Prize"). ARV of Overall Prize $149.00. Overall Prize will be awarded in the winner's name, is non-transferable and is subject to AutoVantage Terms and Conditions and Roadside Terms and Conditions located at http://www.autovantage.com. The total ARV of all the Prizes: $260,149. Odds of winning a Weekly Prize depend upon the total number of Eligible Entries for that particular Weekly Sweepstakes. Odds of winning the Overall Prize depends on the total number of Eligible Entries from each Weekly Sweepstakes. Prize(s) are nontransferable and no substitutions allowed except by the Sponsor who reserves the right to award a prize of equal value if advertised prize is unavailable. All winners are solely responsible for all costs, incidentals and expenses not specifically mentioned as being included. Any depiction of prizes is for illustrative purposes only. All federal, state, or other taxes are sole responsibility of the winners. Limit one (1) prize per person/family/household. Prizes and/or prize notifications will be mailed to street addresses in the U.S. only. Sponsor will fulfill the prizes on or about ninety (90) days after verification of winning and all documentation has been completed, received and verified. Weekly Prize winners will receive an IRS form 1099 from the Sponsor for the total ARV of prize (stated herein) that he/she won in the calendar year that he/she won. Sweepstakes administrator is not the supplier or guarantor of any prize.
Drawing and Notification of Winners: Prior to each the Weekly Sweepstakes drawings, the Sweepstakes administrator will randomly select the Game case number that will be in play for that particular Weekly Drawing. For each Weekly Sweepstakes, one (1) potential Weekly Prize winner will be randomly selected from all Eligible Entries received during the Weekly Sweepstakes Period for that particular Weekly Sweepstakes, in a drawing held on or about the Monday (or if a holiday, the first business day) following that Weekly Sweepstakes ("Weekly Drawing Date"). Non-winning Sweepstakes Entries from a Weekly Sweepstakes will not be eligible for, or retained for any subsequent Weekly Sweepstakes drawings but will be retained for the Overall Sweepstakes drawing. The Overall Prize winner will be randomly selected from among all Eligible Sweepstakes Entries received during the entire Sweepstakes Period in a drawing held on or about September 18, 2009. All drawings will be conducted by the Sweepstakes administrator, an independent judging organization. Each potential Weekly Prize winner will be notified by telephone at the number listed on his/her Entry, between the hours of 11:00 a.m. (PT) and 1:00 p.m. (PT) on or about each Weekly Drawing Date and the potential Overall Prize Winner (or his/her parent/legal guardian, if a resident of a jurisdiction that deems him/her to be a minor) within approximately one (1) day of the Overall Drawing Date. If a potential Weekly Prize winner or the Overall Prize winner cannot be reached after (three (3) phone call attempts within a one (1) hour period, if he/she is found to be ineligible, if he/she cannot or does not comply with these Official Rules, or if his/her prize or prize notification is returned as undeliverable, such potential Weekly Prize or Overall Prize winner will be disqualified, and an alternate potential Weekly Prize or Overall Prize winner may be selected at Sponsor's sole discretion.
General Conditions: This Sweepstakes is subject to these Official Rules and all federal, state and local laws and regulations (collectively "Rules and Laws"). Each potential Weekly Prize winner (or his/her parent/legal guardian, if a resident of a jurisdiction that deems him/her to be a minor) will be required to sign, execute, have notarized, and return an original, unaltered Affidavit of Eligibility, a Liability Release, (where legal) a Publicity Release, an IRS Form W-9 and any other documentation that the Sweepstakes administrator and/or Sponsor may require (collectively "Affidavit/Release"), within three (3) days after receipt, or such potential Weekly Prize winner may be disqualified and an alternate potential Weekly Prize winner may be selected at Sponsor's sole discretion. By returning a completed Affidavit/Release, such winner (or his/her parent/legal guardian, if a resident of a jurisdiction that deems him/her to be a minor) attests to the provisions stated therein including compliance with these Official Rules. A fax copy of winner's Affidavit/Release may be requested and such fax copy will have the same force and effect as the original document. The potential Overall Prize (or his/her parent/legal guardian, if a resident of a jurisdiction that deems him/her to be a minor) winner will be required to complete an Eligibility Questionnaire conducted by telephone by the Sweepstakes administrator. If a Weekly Prize or Overall Prize winner is a resident of a jurisdiction that deems him/her to be a minor, prize will be awarded in the name of his/her parent/legal guardian. Once submitted, Sweepstakes Entries and Affidavit/Releases become the sole property of Sponsor. Notwithstanding anything to the contrary in Sponsor's Privacy Policy and Terms of Use located at http://www.dealornodealclub.com, except where prohibited by law, an Entry and/or acceptance of the applicable prize constitutes permission for the Sweepstakes Entities to use said winner's name, photograph, likeness, biographical information, statements, voice and address (city and state) for advertising/publicity purposes worldwide in any and all forms of media (including but not limited to posting on the Web Site), now known or hereafter devised, in perpetuity throughout the universe without further compensation in connection with the Sweepstakes or the prize awarded. However, Sponsor will not provide any personally identifying information of minors, regardless of its source, to any third party without the express written consent of entrant's parent/legal guardian. Additionally, by opting-in to specific offers from any of the Sweepstakes Entities, entrant's Entry information will be subject to their respective privacy policies and terms of service, and entrant agrees to receive additional email or telephone communication from those companies. The privacy policy for any Sweepstakes Entity participating in an opt-in will be accessible from that particular Entity's web site. Opting in to specific offers does not improve one's chances of winning. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or the Web Site or any Web Site related to the Sweepstakes; to be acting in violation of the Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person in connections with this Sweepstakes. Any person attempting to defraud or in any way tamper with this Sweepstakes will be ineligible to win any prize and will be prosecuted to the full extent of the law. If, for any reason, the Sweepstakes is not capable of running as originally planned, Sponsor, at its sole discretion, reserves the right to cancel, suspend or modify the Sweepstakes or any portion(s) thereof; and, at its sole discretion, Sponsor may, conduct any or all the drawings and award prizes from all salvageable Sweepstakes Entries received for a given Weekly Sweepstakes or all the Weekly Sweepstakes, and/or Overall Sweepstakes. In case of a dispute over the identity of an entrant who submitted a winning Online Entry the authorized account holder of the email address associated with that Online Entry will be deemed the entrant. The "authorized account holder" is deemed the natural person who is assigned to an email address by an Internet access provider, service provider or other online organization that is responsible for assigning email addresses for the domain associated with the submitted email address. In case of a dispute over the identity of an entrant who submitted a winning Telephone Entry, the "authorized account holder" of the land-line or mobile telephone number associated with that Telephone Entry will be deemed the entrant. The "authorized account holder" of a Telephone Entry is the natural person in whose name the telephone has been issued and to whom services are billed. Said "authorized account holder(s)" (as described above for both email and telephone) must comply with these Official Rules and, at Sponsor's sole discretion, may be required to provide proof of ownership of the email account or telephone and/or mobile service account.
Disclaimers: The Sweepstakes Entities are not responsible or liable for, and will deem ineligible, Sweepstakes Entries that are entered by other than human means (such as by an automated computer program or any non-human mechanism, entity, or device), or Sweepstakes Entries that are illegible, late, destroyed, lost, misplaced, stolen, misdirected, garbled and/or disconnected, tampered with, incomplete, deleted, damaged, mutilated, telecommunications, network, electronic, technical, mobile or land-line telephone service, or computer failures of any kind; for Telephone Entry issues due to caller ID blocking; for inaccurate transcription of Entry Information; for errors in any promotional or marketing materials or in these Official Rules; or otherwise not in compliance with these Official Rules. By entering this Sweepstakes, each entrant (or his/her parent/legal guardian, if a resident of a jurisdiction that deems him/her to be a minor) agrees and acknowledges to be bound by the Rules and Laws, as well as the decisions of the Sweepstakes administrator which are final and binding in all respects; to waive any rights to claim ambiguity with the Rules and Laws; and that Sweepstakes Entities shall have no responsibility or liability (including, but not limited to, liability for any property loss, damage, personal injury or death) in connection with: participation in this Sweepstakes; human error; incorrect or inaccurate transcription of Sweepstakes Entry Information; acceptance/possession and/or use/misuse of any prize awarded herein (including, but not limited to, any entity or any other persons providing any of the components for a Weekly or Overall Prize if applicable, due to reasons beyond the control of Sponsor and/or Sweepstakes Entities); any technical malfunctions of a computer online system, computer dating mechanism, computer equipment, software, internet service provider; interruption or inability to access the Sweepstakes, Web Site, or any online service via the internet due to hardware or software compatibility problems; any damage to entrant's (or any third person's) computer or telephone and/or its contents related to or resulting from any part of this Sweepstakes; any lost/delayed/duplicate/multiple data transmissions, omissions, interruptions, defects and/or any other errors or malfunctions, even if caused by the negligence of one of the Sweepstakes Entities. In the event the Overall Prize becomes unavailable (due to unavailability or interruption of service for any reason) after awarded, such prize will be substituted with a prize of equal value by Sponsor (at Sponsor's sole discretion). Each entrant (or his/her parent/legal guardian, if a resident of a jurisdiction that deems him/her to be a minor) further agrees to indemnify and hold harmless the Sweepstakes Entities from any and all liability resulting or arising from the Sweepstakes, to release all rights to bring any claim, action or proceeding against the Sweepstakes Entities, and hereby acknowledge that said Sweepstakes Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize. Sweepstakes Entities shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience or irregularity that may be caused or contributed to (1) by any wrongful, negligent or unauthorized act or omission on the part of the prize supplier or any of its agents, servants, employees or independent contractors, (2) by any wrongful, negligent or unauthorized act or omission on the part of any other person or entity not an employee of Sweepstakes Entities, or (3) by any other cause, condition or event whatsoever beyond the control of Sweepstakes Entities or their parents, subsidiaries and affiliated companies. The failure of Sponsor to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsor(s) (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Official Rules.
DISPUTES: THIS SWEEPSTAKES IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF CONNECTICUT, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN FAIRFIELD COUNTY, CONNECTICUT. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF ("JAMS RULES"). THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN CONNECTICUT. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN THE COUNTY OF FAIRFIELD. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY'S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.
